1. Voice and Performance Rights

The Narrator’s voice, vocal performance, and interpretive delivery as embodied in the recorded audiobook constitute protected intellectual property and performance rights. No ownership or license to the Narrator’s vocal likeness, voice model, or performance style is granted except for the specific purpose of distributing the agreed-upon audiobook in its finalized form.

2. Prohibited AI and Synthetic Use

​

The Rights Holder and/or Publisher shall not, and shall not permit any third party to:

• Use the Narrator’s recorded performance for the purpose of training, fine-tuning, or improving artificial intelligence, machine learning, or synthetic voice systems

• Create or authorize voice clones, synthetic reproductions, or simulated performances derived from the Narrator’s voice

• Use the Narrator’s recordings as part of any dataset intended for automated or generative reuse

• Create derivative works designed to imitate, replicate, or substitute the Narrator’s voice or performance

These prohibitions apply to both commercial and non-commercial AI systems.

3. Rights Holder Duty of Protection

The Rights Holder and/or Publisher agrees to exercise reasonable commercial efforts to protect the Narrator’s recordings from unauthorized AI-related use, including by:

• Limiting access to production files to necessary personnel

• Prohibiting AI training or synthetic reuse within vendor, distributor, or platform agreements where reasonably practicable

• Responding promptly to known or suspected unauthorized AI use involving the Narrator’s voice​

 

4. No Implied Consent

​

Approval of the audiobook for distribution does not constitute consent for AI training, voice modeling, synthetic narration, or any use beyond traditional audiobook exploitation.

Any AI-related use requires separate, explicit, written authorization and a negotiated license.

 

5. Unauthorized Use and Remedies

​

In the event of unauthorized AI-related use of the Narrator’s voice or performance arising from the Rights Holder’s or Publisher’s actions, omissions, or failure to enforce contractual protections, the Narrator shall be entitled to:

• Immediate cessation of such use

• Appropriate compensation, to be negotiated in good faith or as otherwise provided by law

• All other remedies available under applicable copyright, performance rights, and unfair competition laws​

 

6. Survival

​

The provisions of this clause shall survive termination or completion of the Project and shall apply for the full term of copyright protection.
